Things continue to get worse for a 33-year-old man arrested on Thursday on a charge of rape.

William Diggs III finally made a court appearance Monday where he was informed that he will not only face the off grid charge of rape, but also aggravated indecent liberties with a child under Jessica’s Law. If convicted, both carry a life sentence with no chance of parole for 25-years.

Diggs was arrested on the charge by Hutchinson Police after an investigation that began last month. The victim, a 12-year-old girl apparently told a school official who then reported the alleged crime.

The encounter between the two allegedly occurring sometime between Valentines Day and the spring break for Hutchinson school students according to police.

The bond in the case is set at 50-thousand dollar bond and he requested a reduction of that bond when he appeared in front of Magistrate Judge Randy McEwen, but when asked why he thought it should be reduced, he couldn’t give an answer. Assistant District Attorney Andrew Davidson told the judge that considering the charges, the bond should be increased, but certainly not lowered. It the end the judge denied the request of both sides and left the bond where it was.

With the formal charges filed, his case will move to a waiver-status docket in front of Judge Joe McCarville on May 29.

I would think the obvious answer upon innocence to the “why should your bail be lowered?” question is “I didn’t do it your honor.”
