A 50-year-old Mulvane area man has been bound over in Reno County District Court on charges of rape, and aggravated sexual battery.

Jodie Mosier is alleged to have raped a 32-year-old woman at M&M Point at Cheney Lake back on May 30, 2010.

Apparently, officials with the Sedgwick County Sheriff’s Office were told of the sexual assault in that county after the 32-year-old victim contacted law enforcement there. They seized computers from Mosier and apparently found evidence of the crime of rape here in Reno County. Officials here then began the investigation leading to Mosier being arrested on a 50-thousand dollar warrant.

Sheriff Detective Darrian Campbell says that the woman apparently had been drinking at the lake and passed out, and that’s when the alleged sexual assault occurred.

The victim testified that she caught him fondling her under the sheets and also identified his fingers from photos he apparently took of her which were found on his computer.

Also on the stand Monday was Virgil Miller, a detective with the Sedgwick Couty Sheriff’s Office who was investigating a sexual matters case in that county. Mosier apparently had the pictures on his computers and the detective seized three computers and several hard-drives from the home.

The state after resting their case wanted to add a third charge of lewd and lascivious behavior because of the victims children being present, however Judge Joe McCarville sided with the defense that even though the children were present, they were asleep and not aware of the anything going on.

Arraignment in the case will be November 5 in front of Judge Tim Chambers.
